SwingSpace Terms and Conditions

Please read these terms and conditions carefully before using our services.

1. Definitions

 

"We", "Us", "Our" means SwingSpace, the provider of the portable golf simulator.

"You", "Your", "Hirer", "Customer" means the individual or organisation hiring the simulator. 

"Equipment" includes the golf simulator enclosure, hitting mat, projector, screen, sensors, cables, computer systems, and any accessories provided.

"Event" refers to the function, party, activation, or booking period during which the equipment is in use.

"Hire Period" means the agreed duration for which the simulator is booked and in use.

 

2. Booking and Payment 

A booking is only confirmed once a 50% deposit is received.
The balance must be paid to save the date. 

Payments accepted: bank transfer, credit/debit card, and secure Xero payment link.

Late payments may result in cancellation or rescheduling at our discretion.

 

3. Cancellation Policy

  • 7+ days notice: Full refund of deposit.

  • 5–7 days notice: 50% of deposit refunded.

  • Less than 5 days: Deposit is non-refundable.

 

If SwingSpace cancels due to equipment unavailability or force majeure, a full refund will be provided.

Rescheduling initiated by SwingSpace is free of charge.

Rescheduling by the hirer may incur a fee depending on notice period and availability.

 

4. Force Majeure
 

We are not liable for delays or cancellations caused by events beyond our control, including but not limited to natural disasters, pandemics, or government restrictions.

 

5. Security Bond

No security bond is required.

The hirer is liable for any costs associated with damage, repair, or replacement of equipment caused by misuse, negligence, or improper use.

 

6. Delivery, Setup and Collection

We deliver, set up, and dismantle all equipment.

Minimum space required: 3.1m (W) x 2.7m (H) x 1.7m (D).

Recommended space required: 4.1m (W) x 3.1m (H) x 3.1m (D).

Power requirement: 1 x standard 240V outlet within 10 metres.

Setup must occur on flat, stable ground (indoor or outdoor undercover).

Setup and dismantling each take approximately 1 hour.

The hirer must ensure:

○ Easy, unobstructed access for setup.

○ Safe environment free from hazards.

○ Adequate weather protection if used outdoors.

Delays caused by the hirer, including obstructed access or unprepared space, may incur additional charges.

Remote delivery surcharge applies for locations beyond 30km from Melbourne 3000.

 

7. Use of Equipment 

The equipment is to be used only as instructed.

The hirer assumes full responsibility for supervision and safety of all users. 

Only one player is permitted to swing at a time. 

No food, drinks, pets, or smoking inside or near the simulator. 

Children must be supervised at all times.

Users under 16 must be supervised by an adult.

Equipment must not be moved, adjusted, or tampered with.

Misuse of the equipment may result in additional charges or immediate termination of the hire.

 

8. Liability and Insurance

The hirer accepts full responsibility for all damage, theft, or loss during the hire period.

 We are not liable for:

○ Injury to persons using the equipment.

○ Damage to property due to misuse or negligence. 

SwingSpace holds Public Liability Insurance, however, this does not cover damage caused by the hirer or guests.

The hirer is liable for any third-party injury or damage caused by event participants.

The hirer is not liable for normal wear and tear.

For large events, the hirer may be required to provide proof of their own public liability insurance. 

9. Weather and Environmental Conditions

For outdoor events, the hirer is responsible for providing a sheltered or indoor area.

In case of unsafe weather (e.g., winds exceeding 40km/h, lightning, or heavy rain):

○ Equipment may be withheld or dismantled for safety.

○ We may reschedule the event free of charge, subject to availability.

○ If equipment must be dismantled early due to weather, the hirer may still be liable for the full hire fee.

 

10. Waiver and Assumption of Risk

All users acknowledge the inherent risks of using golf-related equipment.

By proceeding with a booking, the hirer:

○ Accepts full responsibility for ensuring all participants use the equipment safely.

○ Indemnifies SwingSpace from liability for injury or damage caused by participants.

Visible signage will inform users that use of the equipment implies consent and risk acceptance.

By using the equipment, users consent to being photographed or filmed for safety or promotional purposes unless otherwise stated.

 

11. Termination of Hire

We reserve the right to cancel or terminate hire without refund if:

○ There is a breach of these terms.

○ Equipment is at risk due to unsafe or abusive behaviour.

○ Users are under the influence of alcohol or drugs.

If termination occurs within the first hour of the hire period, a partial refund may be issued at our discretion.

Termination may be communicated verbally or in writing.

12. Privacy Policy
 

We collect personal information solely for the purpose of managing bookings and providing services.

Your information is never sold or shared without consent.

Data is stored securely and may be deleted upon request. 

In the event of a data breach, we will notify affected individuals as required by law.

Customer data is retained for up to 12 months after the booking date.

13. Consent and Acceptance

By proceeding with a booking, the hirer agrees to these Terms and Conditions and the Privacy Policy.

Acceptance may be confirmed electronically, including by digital signature or online form.

14. Governing Law

These terms are governed by the laws of Victoria, Australia.

Any disputes will first be attempted to be resolved through mediation before legal proceedings.

 

15. Accessibility

We will make reasonable accommodations for hirers or guests with disabilities. Please advise us at the time of booking.

16. Consumer Guarantees

Nothing in these Terms and Conditions limits your rights under the Australian Consumer Law (ACL).

If the equipment is faulty or does not meet acceptable quality, you may be entitled to a repair, replacement, or refund.

 

17. Updates to Terms

We reserve the right to update these Terms and Conditions at any time.

The latest version published on our website or provided at the time of booking will apply.
